Business & Shareholder Disputes

            Ken’s business litigation practice involves representing clients in all manner of business disputes including contract and licensing disputes, unfair competition claims, shareholder disputes in closely held companies, shareholder buy out claims, derivative actions involving publicly traded corporations, and breach of fiduciary duty claims.

Healthcare Fraud

 

           Ken has represented individuals and corporations in numerous healthcare-related matters.  Ken has successfully represented clients in cases involving allegations of healthcare fraud and violations of the False Claims Act, the Anti-Kickback Statute, and the Stark Law.  He has assisted healthcare providers and organizations address qui tam/whistleblower claims, billing fraud investigations and self-disclosure reporting protocols.

 

These matters have included active litigation against the U.S. Department of Justice, the U.S. Attorney’s Office, and the Health and Human Services Office of Inspector General.  Ken has also assisted clients in response to various healthcare fraud investigations by federal and state oversight agencies.

Class Actions

Ken has been lead counsel in class and collective action matters in U.S. District Court and Massachusetts Superior Court.  He has represented clients in class action litigation involving mass torts, financial fraud, multilevel marketing organizations and wage and hour laws.

Government Investigations

Ken has helped clients respond to investigations initiated by government entities including the U.S. Department of Justice, U.S. Attorney’s Offices, the FBI, the U.S. Department of Health and Human Services, the Office of Foreign Assets Control, the Massachusetts Attorney General’s Office, and numerous Offices of Inspectors General.  Ken has also represented clients in securities fraud investigations conducted by the SEC, the Massachusetts Securities Division, and FINRA.

Independent Investigations

In addition to helping clients respond to investigations initiated by government agencies, Ken has conducted independent investigations for colleges, universities, police departments and numerous businesses and organizations stemming from allegations of fraud, embezzlement, theft, and employee misconduct.  These independent internal investigations have resulted in recovery of employee theft and embezzlement, employee discipline and discharge, aided in cooperation with government investigators, and where appropriate, referrals to law enforcement for prosecution.

Complex Civil Litigation

Ken has represented clients in civil litigation matters at all levels of federal and state courts.  His complex civil litigation matters have involved numerous cross-border disputes involving foreign companies, international contracts and distribution agreements, lending and bank fraud, and alleged tax fraud.  He has represented clients in federal multi-district litigation and litigation involving parallel criminal proceedings.  He has successfully tried cases against private litigants, as well as government agencies including the U.S. Department of Justice.
